Introduction

The buyer’s purchase of any items offered on HardcoreFitness.co.za is subject to these terms and conditions and by placing an order for any product, the buyer agrees to be bound by them. The buyer confirms that he/she is of full age or has received parental permission to transact on our website. When the buyer uses any of the services provided by Hardcore Fitness through the website, including but not limited to Product Reviews, the buyer will be subject to the rules, guidelines, policies, terms, and conditions applicable to such a service and will be deemed incorporated into these terms and conditions. These terms and conditions contain specific provisions to limit our liability.

General
In addition to these terms and conditions, the following additional terms also apply to your use of Hardcore Fitness.co.za and its associated features:
• Our Website Terms of Use which govern use of Hardcore Fitness.co.za itself;
Our Privacy Policy and our Cookies Policy which govern use of your personal information submitted to or via Hardcore Fitness.co.za;
• Our Membership General Information which govern your use of your Hardcore Fitness account; and We reserve the right to change these terms and conditions from time to time by changing them on Hardcore Fitness.co.za, although no such change will affect any order you have already placed with us. It is the buyers responsibility to familiarize themselves with the most recent terms and conditions every time the buyer places an order for products.
• You may not access this website for any purpose other than for utilizing the services offered on it in the normal manner. You must not access our site for the purpose of redistributing or otherwise using any of our content for your own business purposes unless you are expressly licensed thereto by us in writing.
• You may not use your access to this website in a manner that would bring us or our business into disrepute. Furthermore, you may not access this site for unlawful purposes or use it in a manner which infringes our rights or the rights of any other person or restricts or inhibits the use or enjoyment of this website by any other person.
• In this regard, you must comply with the laws, regulations and codes of conduct applicable to your use of this website.

Definitions
• “buyer” will mean any natural or legal person who has agreed to become a buyer on the website by registering on the website as a buyer
• “Hardcore Fitness”, “we”, “us”, or “our” refers to Hardcore Fitness Pty (Ltd)
• “website” refer to the website Hardcore Fitness.co.za
• “working days” refer to trading hours starting from 08:00h to 18:00h Monday to Friday excluding Saturdays, Sundays and statutory South African public holidays.
• “order” refers to the collective items in the buyer’s cart that the buyer has purchased online
• “items” The products online that the buyer has chosen while constructing their respective carts
• “products” refers to all products and services listed on Hardcore Fitness.co.za for purchase, including but not limited to delivery, sport apparel and nutrition products

Conditions of Website Use
To be able to buy any products from the website, the buyer warrants the following:
The buyer is at least 18 years of age to register as a buyer on our website
The buyer is transacting under the supervision and monitoring of a legal guardian should the buyer be a minor
The buyer will only transact on our website after having thoroughly read the terms and conditions
The buyer agrees to use our products and services according to the sport that the product was manufactured to perform exceptionally in, and use the service in accordance to the applicable laws and policies governed by third parties.
If the buyer has a Hardcore Fitness account, the buyer is responsible for the information provided on the account and agrees that by uploading information into the account, all the information provided is current, accurate and correct.
The user agrees to provide accurate, complete and current information and will not
impersonate a third party or misrepresent themselves.
Buyer’s Account and Registration Obligations
The Buyer is free to use the website without having registered on Hardcore Fitness.co.za. The buyer will however be required to register on Hardcore Fitness.co.za should they wish to transact on our website.
When the buyer uses the website and/or sends emails (or any forms of communication), the buyer acknowledges that he/she is communicating with Hardcore Fitness using electronic records. In turn, Hardcore Fitness can also communicate with the customer through email and other forms of communication in response to the buyer’s query. The buyer will be held liable for the maintenance of all confidentiality of the buyer’s display name and password. The buyer will also be responsible for all activities that occur under the
buyer’s display name.
Price and Payment

Price
The prices of products quoted on Hardcore Fitness.co.za is as quoted in stores from time to time. Delivery costs are excluded from the price of products quoted on our website and will be automatically calculated and added to your final basket amount due once you have chosen your method of delivery.
The Hardcore Fitness South Africa website Hardcore Fitness.co.za contains a large number of products. It is for this reason that at times, despite our best efforts, some of the products listed on the website may be incorrectly priced. Upon realizing that the actual price of the product is less than the amount the buyer has paid, we will charge the buyer the actual price and refund the outstanding balance. The website displays a large variety of Hardcore Fitness’s products. Orders will be subject to
availability of products.

Payment
Delivery costs
Delivery costs can change at any time but will not affect the buyer who has already paid for delivery. Payments for orders must be made by debit or credit cards via Pay U, SID, and EFT. Hardcore Fitness.co.za does not accept payment made through gift cards and/or vouchers.
As soon as your payment is validated, we will start the picking of your items from our
respective layouts. Should we find that your order is short in stock, we will notify you and you will be presented with the opportunity to choose between requesting a refund or choosing another item worth the same value as the item that has run out of stock.

Delivery
Door-to-Door Delivery
Hardcore Fitness deliver parcels to customers country wide. We do not
deliver outside the borders of South Africa. Orders cannot be delivered to P.O Box or similar addresses. For all products purchased on Hardcore Fitness.co.za delivery is offered as a service and Hardcore Fitness will subsidise the delivery fee on behalf of the buyer for all national deliveries. Local delivery fees for parcels that weigh between 0 -3 kilograms are fully transferred to the buyer and will only be subsidised under exceptional circumstances.
All products purchased within the respective Hardcore Fitness South Africa stores are subject to third party delivery rates should the customer require delivery of store purchases.

Click and Collect
Should the buyer choose click and collect as a method of delivery from our website, the buyer will be required to collect their parcel from the designated address as stipulated in the invoice. Products cannot be set aside for customers for more than 48 hours at a time. After this time period has elapsed, we return the item to the layout and we will consider that you have exercised your right to cancel your request.

Returns & Exchanges
A buyer who has bought an item from Hardcore Fitness.co.za has the opportunity to exchange an item once.
If the product sent to the buyer is not what the buyer was promised in terms of, but not limited to, quality, product specification or the wrong product being sent, the customer can choose to return the product for either an exchange for a similar item, an item that costs the same as the returned item, or for a refund.

Risk and Ownership
ITEMS ORDERED WILL BE AT YOUR OWN RISK FROM THE TIME OF DELIVERY OR COLLECTION. Should you incur damage to your order because of the negligence of either Hardcore Fitness, or the courier, your order will be fully reimbursed or you will receive a new order free of charge.
Ownership of the items ordered will pass to you on delivery or collection provided full
payment of all sums due is received in respect of the products. Intellectual Property
the content posted on the website is subject to property rights protected under intellectual property laws, including, but not limited to, designs, trademarks, domain names, patents, know-how, software or database rights. Hardcore Fitness and its partners retain ownership of all such Content displayed on Hardcore Fitness.co.za and any associated rights.
